Southern Dreamscapes Terms & Conditions1. General
These terms and conditions override any others stipulated by the buyer unless expressly agreed in writing by Southern Dreamscapes ("the seller").Placing an order constitutes the buyer's full acceptance of these terms and conditions.2. Deposits
All deposits are non-refundable unless specifically agreed otherwise in writing.Deposits are only refundable if the seller fails to meet the signed contract requirements.3. Payments
Final payment is required seven (7) days before the scheduled delivery date unless agreed in writing or a finance agreement is in place.For purchases made via finance, payment must be fully approved before the product is ordered or installation begins.Late payments are subject to a 2.5% weekly interest charge.Until full payment (including any delivery and installation fees) is received, all goods remain the property of the seller.The seller reserves the right to recover goods, including disconnecting electrical supply and entering the property, if payment is not received. Any deposit paid may be retained to cover associated costs.If the goods are not agreed by the seller to have been paid for in full, along with delivery and installation charges, the goods will remain the property of the seller. The seller will be entitled to enter the premises or property where the goods are installed, disconnect the electrics, and recover the goods until full payment has been made. If not paid, any deposit secured will be held as part of recovery, delivery, and installation costs.4. Delivery
Delivery dates and times are estimates only. AM or PM windows may be specified but are not guaranteed.The seller reserves the right to cancel or reschedule deliveries due to unforeseen circumstances, with deposit refunds issued where appropriate.The buyer is responsible for preparing the site, including access, level ground, and power supply. The buyer is required at his expense to do all the construction and other necessary acts to meet the requirements for the seller to deliver the goods, install, and operate on the agreed delivery date. If we have to return to commission the hot tub due to electrics not being ready then a charge of £150 will be incurred.The buyer must direct placement of goods and is liable for any issues arising from incorrect placement. The buyer shall direct the installation team and goods and will be liable for the location of placement; the seller will not be liable for any incorrect placement.If the site is not prepared as required, the seller may:Return goods to secure storage, orLeave goods on-site and return at a later date to commission installation.Additional charges will apply for return visits unless otherwise agreed in writing.The seller or his agents will not be held liable for any damages or injuries to goods or property from inadequate site preparation by the buyer or his agents.Goods will be stored free of charge until the agreed delivery month. After this, two (2) weeks’ free storage is provided. Thereafter, storage fees of £10/day apply.Standard delivery includes a two-person team. Additional lifting equipment (e.g., cranes) must be arranged and paid for by the buyer unless otherwise stated.Failed Delivery
If delivery is attempted but fails due to access or site conditions, the buyer may choose to:Have goods left at the front of the property at no extra cost, orHave goods returned to the seller's facility and redelivered once access arrangements (e.g., crane/HIAB) are in place at the buyer's cost.The seller is only liable for failed delivery costs if a site survey was conducted by the seller or their agents.5. Additional Work
The seller is not responsible for the performance or quality of work carried out by third parties.Referrals made by the seller are professional courtesies and do not imply responsibility or liability.Damage caused by third-party preparation or installation will not be covered by the seller.Where the buyer has work completed by others that is not provided for in this contract, the seller does not guarantee or warrant such work, nor will the seller be responsible for damage to goods if problems occur. Referrals from the seller to complete preparation work are given as a professional courtesy only. The seller is not responsible for any conduct or service provided by these referrals.6. Warranties
Warranty coverage is contingent upon compliance with these terms, including full payment and routine servicing.A yearly service is required to maintain warranty validity.The seller agrees to repair or replace defective parts covered under the warranty.Warranties are effective only if the buyer has complied with all the terms and conditions, payments, and provisions of the contract.7. Complaints
All complaints must be submitted in writing via email to [email protected] or sent to the registered address stated in official company correspondence or found on the header of this document.8. Limitation of Liability
The seller accepts no liability for damage to property (e.g., driveways, patios, lawns) during delivery/installation unless caused by gross negligence.The buyer is responsible for protecting vulnerable surfaces and ensuring adequate access.9. Utilities & Services Disclaimer
The buyer must ensure that electrical and water supplies are suitable and compliant with relevant regulations.The seller is not liable for faults caused by inadequate or non-compliant connections.10. Electrical Work
Electrical work is not included unless explicitly stated.Responsibility for electrical safety and connections lies with the buyer.11. Water Chemistry & Maintenance
The buyer is solely responsible for ongoing water care and chemistry.Warranty claims arising from poor water maintenance (e.g., limescale, corrosion) will be rejected.12. Access for Service
The buyer must ensure safe and unobstructed access for servicing or repairs.Additional fees may apply if the product must be relocated to allow access.13. Modifications & Relocations
Any unauthorised modification or relocation of the goods voids the warranty.14. Force Majeure
The seller is not responsible for delays or failures due to events beyond their control, including extreme weather, transport issues, or supplier delays.15. Indemnity
The buyer agrees to indemnify the seller against any loss or damage caused by improper use, installation, or failure to follow operational guidelines.16. Sauna Installations
All sauna installations must be connected by a qualified electrician. Proper ventilation is the buyer's responsibility. We are not liable for damage caused by poor ventilation or incorrect setup.For indoor installations, the buyer must ensure the room is heat and humidity resistant. Damage to interiors from steam or heat is not our responsibility.Buyers must follow maintenance and usage guidelines to keep warranty valid.17. Ice Baths
Ice baths are for general wellness use. We are not liable for health effects – buyers should consult a doctor if unsure.Water hygiene and regular water changes are the buyer’s responsibility. Damage from freezing or poor maintenance is not covered.Ice baths must be placed on a level, well-drained surface. Water damage from overflows is not our responsibility.18. Landscaping Services
Landscaping work will match the written quote. Changes must be agreed in writing and may incur extra cost.We are not liable for delays due to poor ground conditions (e.g., roots, buried pipes). Remedial work may cost extra.We do not guarantee survival of turf, trees, or plants unless we maintain them under a separate contract.Work may be delayed due to weather. Waste removal is only included if stated in the quote.19. Hot Tub Responsibility Disclaimer
The seller is not responsible for the chemical balance or water quality of the hot tub after delivery. Any issues, including diseases or damage resulting from poor or incorrect water care, are the sole responsibility of the buyer.These terms and conditions are governed by the laws of England and Wales.
